      We hired flexsin technologies to build software for us in July 2022. They agreed to sign NDAs and all relevant paperwork. They prepared the NDA as they preferred it and sent it to us for review and signature. We reviewed the NDA and changed the Jurisdiction to UK and sent it back to them for a signature which they delayed in signing up to date. After they reviewed everything, they gave us an estimation of USD 17,000. They sent us a contract with upper price cap stating that any extra activities and costs incurred above the agreed upper price cap will be their responsibility and we as the client will have to pay nothing extra. They estimated the project will take 12-14 weeks. They started the project and assured us the NDA and Contract is getting sorted and they will send it over as soon as. Long story short flexsin Technology never honoured the contract and the price cap as the price started increasing past the price cap. It is now been 8 months since they started the project and they have not signed the NDA nor the Contract as agreed. We noticed they misspelt the names on the NDA and Contract. We asked them to rectify the spelling mistakes and they have refused asking us to Change the NDA that they wrote themselves to meet their interests. They are asking us to include on the NDA that UPwork will resolve disputes in relation to incorrect spellings on the paperwork and the NDA as if they are planning to make more mistakes. Up work is just a platform that brings developers and clients together, UPwork does not resolve spelling mistakes and unsigned paperwork. UPwork is NOT developing our software for us, we did NOT share the software information with UPwork, we shared information with Flexsins Technologies and above all Up work did NOT misspell or fail to sign the NDA or Contract, that was Flexsins Technologies mistakes to fix and NOT UPwork mistakes to fix. They are now asking to write another contract for more money probably with another price cap just to lure. They have agreed to send the assets back to us immediately. That deadline was their own suggestion. They missed it. We extended to January, then February, then April, then issued a formal written Notice of Breach before giving them one final deadline the following June. Every deadline was missed. We were over 300% over timeline.When we finally handed the codebase to a second development firm, the app would not build on either iOS or Android. We paid thousands just to get it running enough to assess the damage. The contracted team was never fully assembled. Tickets were put on hold without explanation. Subscription management, the most critical feature of the app, was broken for months and never fixed by Naked.The commercial video Naked produced was unusable by launch, as cultural references had gone stale during the delay.We are software engineers who have led teams of over 100. These were not minor issues. They were basic, objective engineering failures.When we raised breach concerns with founder John Driscoll, his response was "let's just let our lawyers talk about it."We are aware of more than a dozen other former clients who experienced similar issues. My very small internal team and I ended up doing much of the project management and QA work ourselves because progress had stalled so severely. Despite constant reassurances, no functional product was ever delivered.By mid-2023, I hired multiple external development teams to assess the code. Every single one independently concluded that the app was non-functional, unstable, not scalable, and could not be launched. They warned it would crash immediately and required a complete rebuild. I then hired a neutral third-party auditor with zero connection to any agency and his report confirmed the same findings.After paying over $200K, I had nothing usable. When I factored in delays, internal time lost, expert audits, and the cost of rebuilding from scratch, the financial impact to my business exceeded $500,000.After multiple attempts to resolve the situation privately were unsuccessful, I filed a lawsuit, which is now a matter of public record (Superhuman Inc. v. Naked Development). The case is set for trial in early 2026. While litigation is never something a founder hopes for, at a certain point it became the only responsible path given the evidence and the financial damage.I strongly recommend extreme caution when considering this agency.
